China’s Unreliable Entity List – An overview and implications for businesses

MOFCOM promulgated the Provisions on the Unreliable Entity List (“Provisions”) on the 19 September 2020 which became effective immediately. In this issue, we consider the interaction between the Provisions and the Export Control Law of the People’s Republic of China (“ECL”) which was promulgated on 17 October 2020 and compare the respective entity list regimes of the U.S. and China.
